Flat Fee

A negotiated single value to be paid, regardless of the sales volume.

Sliding Scale

A sliding scale of fees for license is part of the flexibility needed to offer a licensing model from the single, home developer to the large commercial enterprise. The scale means that all payment is calculated as a percentage of each transaction in which a user purchases the licensed product. This ties revenue to volume of sales.

The percentage is based on many factors, but is finalized with the provision that a product price range must be set prior to final agreement. If the licensee ever plans on dropping their price below or raising it above this range or fixed value, the license must be renegotiated prior to this change.

Sales Reporting

The licensee must have a proven and exstablished method for providing sales figures for the licensed product(s).

Transaction Processing

should any specific license contain a a payment instant schedule based on a sliding scale, the licensee must have the means to process and conduct a financial transaction to the extent that the fee covered under the license is paid into an account specified by the licensor.

Scope

Content Ratings

Typically this must be set as part of a license agreement. Language, visual images and portrayal of violence and nudity are part of any game or entertainment component. There exists different ratings bodies for each platform. You will be asked to get and provide proof of review and any certification by a industry recognized [or required] authority for a rating. This rating may not change under most licensing schemes. Change of such ratings or inclusion of easter-egg type media components that may violate the rating are ground for cancellation of the license.

Duration

Licenses are typically in perpetuity. As long as the rest of the terms of the licensing agreement are fulfilled, the license is perpetual. A licensee can cancel the agreement at any time.

Cancellation

The license can be cancelled by the licensee at any time or by the licensor for a violation of terms. Cancellation of license means that any product created with that license can no longer legally be sold.
